By requesting, joining, agreeing to, enrolling in, signing up for, acknowledging, or otherwise consenting to receive one or more text messages from Black Box Dumpster, LLC (“Black Box Dumpster,” “we,” “us,” “our”) through our messaging platform (“Platform”), you accept these Terms & Conditions (“Opt-In”).
Notice Regarding Dispute Resolution
This Agreement contains provisions that govern and limit how claims you and Black Box Dumpster have against each other are resolved. It also contains an agreement to arbitrate, which will—with limited exception—require you to submit claims to binding and final arbitration, and:
(A) You will only be permitted to pursue claims against us on an individual basis, not as part of any class or representative action; and
(B) You will only be permitted to seek relief (including monetary, injunctive, and declaratory relief) on an individual basis.
1. Opting In
By opting in, you authorize Black Box Dumpster to use autodialer or non-autodialer technology to send text messages to the cell phone number associated with your opt-in. This may include promotional or marketing messages, service updates, and notifications.
- You confirm that you are the subscriber or authorized user of the mobile number provided and have permission to receive messages.
- You consent to the use of an electronic record to document your Opt-In.
- You may receive one or more welcome or administrative messages (for example, confirming your subscription).
- You do not have to opt in as a condition of purchasing any goods or services.
2. About the Text Message Services and Opting Out
- Message and data rates may apply.
- You must have a mobile device capable of receiving SMS/MMS messages and a wireless plan with a participating carrier.
- Message frequency may vary.
- We may terminate messaging services or your participation at any time, with or without notice.
To stop receiving messages, you may text STOP, END, CANCEL, UNSUBSCRIBE, or QUIT at any time. You may also text HELP for assistance.
Other methods of opting out (such as verbally requesting removal) are not guaranteed to be effective.
After opting out, you may receive one final confirmation message.

3. Dispute Resolution
Any dispute or claim arising out of or relating to the Platform will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if they qualify. The Federal Arbitration Act and federal arbitration law apply.
Agreement to Arbitrate
By agreeing to arbitration, you understand and agree that:
- You are waiving your right to bring claims through other legal processes (such as a court action).
- There is no judge or jury in arbitration.
- The arbitrator can award the same damages or relief as a court, but only on an individual basis.
To begin arbitration, you must send a demand to the American Arbitration Association (AAA) describing your claim and provide a copy to:

Arbitration will be conducted by the AAA under its Consumer-Related Disputes procedures. Fees will follow AAA rules; we will reimburse filing fees for claims under $10,000 unless the arbitrator finds them frivolous.
Both parties agree to:
- Conduct arbitration only on an individual basis, not as a class or representative action.
- Waive any right to a jury trial.
Either party may bring a claim in court solely to seek injunctive relief for misuse of intellectual property.
If any term in this section is found unenforceable, the remaining terms remain in effect. These provisions survive termination of your participation in the Platform.
4. Limitations, Restrictions, and Miscellaneous
No Warranties
THE PLATFORM AND ALL RELATED CONTENT ARE PROVIDED “AS IS” AND “WITH ALL FAULTS.” ALL WARRANTIES—EXPRESS OR IMPLIED—INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT, ARE EXPRESSLY DISCLAIMED TO THE FULLEST EXTENT PERMITTED BY LAW.
Phone Number Responsibility
If you discontinue or transfer your phone number, you agree to first opt out of our text program. Failure to do so may result in liability for messages sent to the new subscriber of that number.
You agree to indemnify and hold harmless Black Box Dumpster and its affiliates from any claims, damages, or expenses (including attorney’s fees) arising from your failure to notify us of such changes, including claims under the Telephone Consumer Protection Act (47 U.S.C. § 227) or similar laws.
Age Restrictions
You may not use or engage with the Platform if you are under 13 years of age.
If you are between 13 and 18, you must have permission from a parent or guardian. By participating, you confirm that you are permitted by your jurisdiction’s laws to use the Platform.
Prohibited Content
You agree not to send or transmit any prohibited content through the Platform, including:
- Fraudulent, threatening, harassing, defamatory, or obscene material;
- Discriminatory or hateful content;
- Malware, viruses, or malicious code;
- Unlawful products, services, or promotions; or
- Protected personal or health information (e.g., HIPAA-covered data).
General Terms
- You represent that you have all rights and authority to agree to these Terms & Conditions.
- Failure to enforce any term is not a waiver of that term.
- If any provision is invalid, the rest remain enforceable.
- Updates to these Terms may occur at any time, and you will be notified of material changes. Continued use of the Platform after such updates constitutes acceptance.
